Spray park designed for Dutchess County Dep. Of Public Works in 2011 by Cumhur Maden. Production of Aquajeux equipment completed in 2012, installation by Clark Construction Services, Inc. completed later on same year.

Playground designed for Pawling Schools in 2009 by ACM Playgrounds. Modular play equipment manufactured by Playcraft Systems and the installation provided by by Safety 1st Playgrounds on the same year.

 Order Policy, Terms and Conditions:

  • To start the order process the Proposal form needs to be signed. A Release For Production (RFP) form will be issued confirming the order. Please review the order quantities, colors, and model numbers and inform any discrepancy.

 

  • Please indicate the color selection when ordering (include signed copy of the approval page to avoid any error).

 

  • Street address with ZIP code is required along with delivery contact phone number (preferably, cell number of the person who is authorized to accept the delivery). We do not provide drop shipments for 3rd parties, all orders will be shipped to the ordering part only.

 

  • Signed copy of the Release For Production (RFP) is required to start manufacturing process. We do not process Purchase Orders; without signed copy of the RFP received and payment terms are met, orders will not be processed. If applicable, include Tax Exemption Certificate or Resale Certificate at the time of the order.

 

  • Down payments are calculated from the original list price. If applicable, discounts are given as Prompt Payment Discounts only and apply to the remaining balance. Orders under $5,000 (excluding shipping), all part orders and residential orders require pre-payment.

 

  • Prices given in unit price form with estimated quantities. Actual quantities will be billed . Surfacing products, items that are sold in pairs, bundles. And skids are job specific and change of quantities may increase the unit prices.

 

  • Proposals valid for 30 days. Prices subject to change with important variation of currencies, increase on raw materials and related production cost. Shipping and Handling costs are estimated, and actual cost will be billed. All shipments to single destination.

 

  • Multiple shipments, advance shipments, changes of the destination will change the freight estimate and it will be added to your final invoice (please note our shipping estimates always for the referenced project location).

 

  • The estimated week of the shipment will be available after the order is processed. Once the manufacturing process is completed you will be notified. Please prepare a check for the remaining balance to release the shipment.

 

  • Unloading of the equipment is the responsibility of the customer. Make sure that you have staff and equipment to unload on site. Additional charges will apply for any of the following freight related services: lift-gate service, residential delivery and special handling. Delivery location must be accessible by a 53 feet enclosed trailer; additional fees may occur if delivery site is not accessible.

 

  • A third-party Freight company will call the delivery contact person to coordinate the delivery. Once you have the delivery, please inspect your order; if you notice any damage, state clearly on the delivery receipt and report to our office immediately (digital pictures supporting the claim is recommended).

 

  • Payments due prior to the shipment from manufacturer and services being performed. Customers responsible to accept the deliveries in 10 ccdays of the shipment notice. There is a 5% penalty for all late payments, so we appreciate your immediate response. Late and short payments will cancel any discount offers. Administrative fee of 3% and 25% annual finance charge and collection expenses including reasonable attorney fees and disbursements will apply to all late accounts.

 

  • For international; orders, if the payment delayed on the release of shipment, off-site storage, additional transportation and brokerage fees apply. Any payment received will be applied to the first aged / open account (if any) including unpaid balances of the manufacturers or installers that we represent.

 

  • If your agency requires professional design work and engineering, our consulting service fee starts from $3,500.00 per design/area (depending on the size of the project)+ travel expenses (where site visits and meetings require). Consulting fees are due 50% at the start of the work and balance due upon completion.

 

  • If your contract or agency requires a Safety Audit / Inspection for the products supplied by others the fee of the site visit starts from $1,125.00 per structure/area (depending on the size of the project)+ travel expenses (where applicable). Audit and inspection fees are due in advance.

 

  • For the products that were ordered through ACM, if your contract requires site inspection, on-site training or you need site visits, the fee for the site visit starts from $675.00 per structure/area + travel expenses (where applicable). Audit, inspection, on-site training and other service fees are due in advance.

 

  • Professional Design and Engineering services available upon request. Design fees due with progress; fee schedule starts with $3,750.00 and/or 12.5% of the equipment, and applicable time + travel expenses. Consulting services over the phone, skype or similar starts from $500.00 flat fee covering the first hour and will be billed $350.00 / per hour thereafter (duration of the calls calculated 15 min intervals).

 

  • Due to safety regulations and insurance requirements all Safety Audits and Inspections perform for entire play area limits which includes play structures, surfacing, furnishings and immediate surroundings. We cannot perform partial audits and inspections.

 

  • We have right not to provide products or services if we see safety concerns, practices against regulations and manufacturer’s’ recommendations. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order. We reserve the right not to accept an order or cancel an order for default on accounts or misbehaviors.

 

  • All Sales are Final. There are no refunds or cancellations due to the custom nature of the business. Customers are responsible for 100% of the order amount. Service fees including Audits, Inspections, On-site Training and Design Consulting fees are not refundable. For all other products, customer responsible for 30% Re-stocking fee + both-way shipping expenses.
